Terms and Conditions for GetSobr

These Terms and Conditions ("Terms") govern your use of the mobile application GetSobr — Days Clean Tracker ("GetSobr", "the app", "we", "us", or "our"), provided by Efeat Digital. By downloading, accessing, or using the app, you agree to be bound by these Terms. If you do not agree, please do not use the app.

1. Important Health and Medical Disclaimer
Please read this section carefully.
GetSobr is a self-help and habit-tracking tool for personal motivation only. It is not a medical device and does not provide medical, psychological, therapeutic, or addiction-treatment advice.
The app is not a substitute for professional medical advice, diagnosis, or treatment, or for professional addiction or mental-health care.
Always seek the advice of a qualified physician, therapist, or other healthcare provider with any questions you have regarding a medical condition, substance use, withdrawal, or recovery.
Withdrawal from certain substances (including alcohol and other drugs) can be dangerous or life-threatening. Do not start, stop, or change any treatment based solely on the app. Consult a healthcare professional before making changes to your use of any substance.
Never disregard professional medical advice or delay seeking it because of something in this app.
If you are in crisis, having thoughts of self-harm, or experiencing a medical emergency, call your local emergency number immediately or contact a crisis hotline in your country.
You use GetSobr entirely at your own risk and are solely responsible for your health decisions.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your country) to use GetSobr. By using the app, you represent that you meet this requirement and that you have the legal capacity to accept these Terms.
3. License to Use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use GetSobr on devices you own or control, for your personal, non-commercial use.
You agree not to:
Copy, modify, distribute, sell, or lease any part of the app;
Reverse engineer, decompile, or attempt to extract the source code, except where permitted by law;
Use the app for any unlawful purpose or in any way that could damage or impair the service;
Circumvent, disable, or interfere with security-related features, including the premium subscription mechanism.
4. Subscriptions, Billing, and Cancellation
GetSobr offers optional auto-renewing premium subscriptions ("Premium") that unlock additional features.
Pricing and billing period are shown in the app at the point of purchase and may vary by region and over time.
Payment is charged to your Google Play or Apple App Store account at confirmation of purchase.
Auto-renewal: Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
Managing or cancelling your subscription is done through your Google Play or Apple App Store account settings, not through us.
Free trials / introductory offers (if offered): any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
Refunds are handled by the app store according to its policies. We generally cannot issue refunds directly.
We use RevenueCat to manage subscription entitlements. Your purchase is also subject to the terms of the relevant app store.
5. Your Content and Data
GetSobr stores the information you enter (such as the habits you track, your reasons, dates, streaks, and badges) locally on your device. You are responsible for this information and for keeping your device secure. We do not back up this content, and it may be lost if you uninstall the app, change devices, or clear app data.
Our handling of data is described in our Privacy Policy, which is incorporated into these Terms by reference.
6. Intellectual Property
The app, including its design, code, text, graphics, logos, and the "GetSobr" name, is owned by Efeat Digital or its licensors and is protected by intellectual property laws. Except for the license granted in Section 3, no rights are transferred to you.
7. Third-Party Services
The app relies on third-party services, including Google Play, the Apple App Store, and RevenueCat. Your use of those services is subject to their respective terms and policies. We are not responsible for third-party services.
8. Disclaimer of Warranties
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that any results or outcomes (including staying sober or clean) will be achieved.
9. Limitation of Liability
To the maximum extent permitted by law, Efeat Digital and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the app, including any health-related decisions or outcomes.
To the maximum extent permitted by law, our total aggregate liability for any claim relating to the app shall not exceed the greater of (a) the amount you paid us for the app in the 12 months before the claim, or (b) EUR 20.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud).
10. Indemnification
You agree to indemnify and hold harmless Efeat Digital from any claims, damages, liabilities, and expenses arising out of your misuse of the app or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the app at any time if you breach these Terms. You may stop using the app at any time by uninstalling it. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property) will continue to apply.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date reflects the latest version. Continued use of the app after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-law rules, and subject to any mandatory consumer-protection rights you have in your country of residence. Where required by law, disputes may be brought in your local courts.
