These Terms and Conditions ("Terms") govern your use of the ChemHelp: Chemistry Solver mobile application ("the App", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Study aid — not professional advice
ChemHelp is provided as an educational study aid. Its solutions, explanations, balanced equations, and quizzes are generated by artificial intelligence and can be incomplete or incorrect.
The App does not guarantee the accuracy of any answer.
Always verify important work with a qualified teacher, textbook, or other authoritative source.
Do not rely on the App for any safety-critical, laboratory, medical, or professional decision. Follow your institution's safety guidance for any hands-on chemistry.
2. Eligibility
You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App. If you are under 18, you should use the App with the involvement of a parent, guardian, or teacher, and any purchases must be authorized by them. By making a purchase you represent that you are of the age of majority or have such authorization.
3. License to use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and the applicable app store terms (Apple App Store and/or Google Play).
4. Your content
"Your Content" means any photos and information you upload, capture, or enter in the App (including problem images and typed questions).
You retain ownership of Your Content. You grant us a limited license to process Your Content solely to provide the App's features (for example, transmitting a problem to our AI provider to generate a solution).
You are responsible for Your Content and represent that you have the right to upload it and that it does not violate any law or third-party rights.
Do not submit content that is illegal or infringing, and do not use the App to facilitate academic dishonesty in violation of your institution's rules.
5. Subscriptions, payments, and renewals
Certain features require a paid subscription ("Premium"). Prices and billing periods are shown in the App before purchase.
Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the period ends.
You can manage or cancel your subscription in your Apple App Store or Google Play account settings. Deleting the App does not cancel your subscription.
Except where required by law, payments are non-refundable. Refund requests are handled by Apple or Google according to their policies.
Any free trial or promotional offer is subject to the terms presented at the time of the offer; unused portions are forfeited upon purchasing a subscription.
6. Acceptable use
You agree not to:
Use the App for any unlawful purpose or in violation of these Terms;
Reverse engineer, decompile, or attempt to extract source code, except as permitted by law;
Interfere with or disrupt the App or its servers;
Attempt to bypass usage limits, paywalls, or security measures (other than legitimate, authorized reviewer access);
Upload malicious code or content that infringes others' rights.
7. Intellectual property
The App, including its design, text, graphics, and software (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
8. Third-party services
The App relies on third-party services, including OpenAI (AI processing), RevenueCat (subscription management), and the Apple App Store and Google Play (distribution and payments). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.
9. Disclaimer of warranties
THE APP AND ALL GENERATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SOLUTIONS ARE ACCURATE OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR RELIANCE ON ANY GENERATED CONTENT OR YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM, OR USD 50, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of Your Content, your use of the App, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including Sections 1, 9, 10, and 11) will survive.
13. Governing law
These Terms are governed by the laws of Germany, without regard to its conflict-of-laws rules. Any disputes shall be subject to the courts located in Germany, unless applicable law provides otherwise.
14. Changes to these Terms
We may modify these Terms from time to time. We will update the "Last updated" date and, where appropriate, notify you within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
